    The Website constitutes an intellectual work protected by the provisions of the French Intellectual Property Code and applicable International Regulations. Users may not in any way reuse, transfer or exploit for their own account all or part of the elements or works of the Website.

    Use of the Website implies full acceptance of the general terms and conditions of use set out below. These terms of use may be modified or supplemented at any time, so users of the Website are invited to consult them regularly.

    This Website is normally accessible to users at all times. VITALAC may decide to interrupt access for technical maintenance and will endeavour to inform users in advance of the dates and times of any such interruption. In the same way, the legal notices may be modified at any time: they are nevertheless binding on the User who is invited to refer to them as often as possible in order to take note thereof.

Nevertheless, it reserves the right to interrupt the hosting service for the shortest possible period of time, in particular for the purposes of maintenance, improvement of its infrastructures, failure of its infrastructures or if the Services generate traffic deemed abnormal.

    VITALAC and the host cannot be held responsible in the event of malfunctioning of the Internet network, telephone lines or computer and telephony equipment, particularly in the event of network congestion preventing access to the server.

 

  • 5. Intellectual property and counterfeiting 

    VITALAC is the owner of the intellectual property rights and holds the rights of use on all elements accessible on the website, more specifically all text, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication, adaptation of all or part of the elements on the Website, regardless of the means or the process used, is prohibited, except with the prior written authorization of: VITALAC.

    Any unauthorised use of the Website or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.

 

  • 6.  Limitation of liability 

    VITALAC acts as the publisher of the Website. VITALAC is responsible for the quality and accuracy of the Content it publishes.

    VITALAC cannot be held responsible for direct and indirect damage caused to the User's equipment when accessing https://www.vitalac.eu/, and resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or an incompatibility.

    VITALAC cannot be held responsible for indirect damages (such as loss of business or loss of opportunity) resulting from the use of the https://www.vitalac.eu/ website. Interactive areas (possibility to ask questions in the contact area) are available to Users.     The Customer is informed of the regulations concerning marketing communication, the Law of 21 June 2014 on Confidence in the Digital Economy, the Data Protection Act of 06 August 2004 as well as the General Data Protection Regulation (GDPR: No. 2016-679).

     

      • 7.1 Party responsible for the collection of personal data

        For the Personal Data collected in the context of the creation of the User's personal account and his navigation on the Website, the party responsible processing Personal Data is: VITALAC represented by Mr Julien LE CALVEZ, its legal representative.

        As the party responsible for processing the data it collects, VITALAC is committed to respecting the legal provisions in force. In particular, it is the Customer's responsibility to establish the purposes of its data processing, to provide its prospects and Customers, once their consent has been collected, with full information on the processing of their personal data and to maintain a register of processing operations that complies with reality. Whenever VITALAC processes Personal Data, VITALAC takes all reasonable steps to ensure that the Personal Data is accurate and relevant to the purposes for which VITALAC processes it.

      • 7.2 Purpose of the data collected

        VITALAC may process all or part of the data:

        VITALAC does not sell your personal data, which is therefore only used for statistical and analytical purposes.

        • to enable browsing on the Website and management and traceability of services ordered by the User: connection and use data of the Website, invoicing, order history, etc.
        • to prevent and fight against computer fraud (spamming, hacking, etc.): computer equipment used for navigation, IP address, password (hashed).
        • to improve navigation on the Website: connection and usage data.
        • to conduct optional satisfaction surveys on VITALAC: email address.
        • to conduct communication campaigns (sms, email): telephone number, email address.
      • 7.3 Right of access, rectification and opposition

        In accordance with current European regulations, Users of https://www.vitalac.eu/ have the following rights:

        As soon as VITALAC becomes aware of the death of a User and in the absence of instructions from him, VITALAC undertakes to destroy his data, unless their retention proves necessary for probative purposes or to meet a legal obligation.         In this case, the User must indicate the Personal Data that he/she would like VITALAC to correct, update or delete, identifying him/herself precisely with a copy of an identity document (ID card or passport). Requests for deletion of Personal Data will be subject to the obligations imposed on VITALAC by law, notably in terms of the retention or archiving of documents.       • 7.4 Non-disclosure of personal data

        VITALAC will not process, host or transfer Customer Information to a country outside the European Union or to a country whose data protection measures are considered "inadequate" by the European Commission without prior notification to the Customer. However, VITALAC remains free to choose its technical and commercial subcontractors on condition that they present sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: No. 2016-679).

        VITALAC undertakes to take all necessary precautions to preserve the security of the Information and in particular to ensure that it is not communicated to unauthorised persons. However, if an incident affecting the integrity or confidentiality of the Customer's Information is brought to VITALAC's attention, VITALAC shall promptly inform the Customer and communicate the corrective measures taken. Furthermore, VITALAC does not collect any "sensitive data".

        The User's Personal Data may be processed by VITALAC's subsidiaries and subcontractors (service providers), exclusively in order to achieve the purposes of this policy.

        Within the limits of their respective attributions and for the purposes mentioned above, the main persons likely to have access to the data of the Users of https://www.vitalac.eu/ are mainly the agents of our customer service.

    • 7.5 Types of data collected

      With regard to the Users of https://www.vitalac.eu/, we collect the following data which are essential for the functioning of the service, and which will be kept for a maximum period of 12 months after the end of the contractual relationship: surname, first name, postal address, email, telephone number.

      VITALAC also collects information to improve the User experience and to provide contextualized advice: The type of equipment used, the browser used, the IP address, and the various events that occurred during your visit to the Website.

  • 8. Incident notification

    No matter how hard you try, no method of transmission over the Internet and no method of electronic storage is completely secure. Therefore, we cannot guarantee absolute security. If we become aware of a security breach, we will notify affected Users so that they can take appropriate action. Our incident reporting procedures take into account our legal obligations, both at national and European level. We are committed to fully informing our Customers of all matters relating to the security of their account and to providing them with all the information necessary to help them meet their own regulatory reporting obligations.

    No personal information of the User of the https://www.vitalac.eu/ website is published without the User's knowledge, exchanged, transferred, ceded or sold on any medium to third parties. Only in the event of the acquisition of VITALAC and its rights could the said information be transmitted to a purchaser of the company which would in turn be bound by the same obligation of retention and modification of the data with respect to the User of the https://www.vitalac.eu/ website.

    Security

    To ensure the security and confidentiality of Personal Data and Personal Health Information, VITALAC uses networks protected by standard features such as firewalls, pseudonymisation, encryption and passwords.

  • 9. Hypertext links, cookies and internet tags

    A cookie is a small information file sent to the User's browser and stored in the User's terminal (e.g. computer, smartphone), (hereinafter "Cookies"). This file includes information such as the User's domain name, the User's Internet service provider, the User's operating system, and the date and time of access. Cookies will not damage the User's terminal in any way.

    VITALAC may process information about the User's visit to the Website, such as pages viewed, searches performed. This information enables VITALAC to improve the content of the Website and the User's navigation.

      • 9.1 « COOKIES »

        A cookie is a small information file sent to the User's browser and stored in the User's terminal (e.g. computer, smartphone), (hereinafter "Cookies"). This file includes information such as the User's domain name, the User's Internet service provider, the User's operating system, and the date and time of access. Cookies will not damage the User's terminal in any way.

        VITALAC may process information about the User's visit to the Website, such as pages viewed, searches performed. This information enables VITALAC to improve the content of the Website and the User's navigation.

        Cookies facilitate browsing and/or the provision of services offered by the Website, and the User may configure his/her browser to allow him/her to decide whether or not to accept them so that Cookies are stored in the terminal or, on the contrary, that they are rejected, either systematically or according to their sender. The User may also configure his/her browser so that the option to accept or reject Cookies is proposed from time to time, before a Cookie is likely to be recorded in his/her terminal.         If necessary, VITALAC declines all responsibility for the consequences related to the degraded functioning of the Website and of the services that may be offered by VITALAC, resulting from the refusal of cookies by the User or from the impossibility for VITALAC to record or consult the cookies necessary for their functioning due to the User's choice. For the management of Cookies and User's choices, the configuration of each browser is different. It is described in the browser's help menu, which will show how the User can change his/her preferences regarding cookies.

        At any time, the User can choose to express and modify his/her preferences with regard to Cookies. In addition, VITALAC may use the services of external service providers to assist in collecting and processing the information described in this section.

        Finally, by clicking on the icons dedicated to social networks on the VITALAC website and if the User has accepted the deposit of cookies by continuing to browse the VITALAC website, social networks may also deposit cookies on your terminals (computer, tablet, mobile phone).

        These types of cookies are only deposited on your terminals if you consent to them, by continuing your navigation on the VITALAC website. At any time, the User may revoke his/her consent for VITALAC to place such cookies.

     

    • 9.2 INTERNET TAGS

      VITALAC may occasionally employ tags, action tags, single-pixel GIFs, clear GIFs, invisible GIFs, and one-to-one GIFs, and deploy them through a web analytics partner that may be located (and therefore retain information about them, including the User's IP address) in a foreign country.

      These tags are placed both in the online advertisements allowing Users to access the Website and on the various pages of the Website.

      This technology allows VITALAC to assess visitors' responses to the Website and the effectiveness of its actions (e.g., the number of times a page is opened and the information viewed), as well as the User's use of the Website.

      The external service provider may collect information about visitors to the Website and other websites through the use of these tags, compile reports on Website activity for VITALAC, and provide other services related to the use of the Website and the Internet.

 

  • 10. Applicable law and jurisdiction

    Any dispute relating to the use of the https://www.vitalac.eu website is subject to French law. Except in cases where the law does not allow it, the competent courts of Saint-Brieuc have exclusive jurisdiction.
